The Supreme Court of Canada has made a decision to overturn a narrow victory by a federal Liberal candidate in the 2025 federal election in order to uphold the trust of the public in the electoral system. The court stated that annulling the election outcome guarantees that a federal election is not influenced by identifiable and correctable administrative errors.
Tatiana Auguste, a Liberal candidate, was initially declared the winner in the Terrebonne riding in Montreal with a one-vote margin over the incumbent Bloc Québécois candidate, Nathalie Sinclair-Desgagné, in April 2025. Sinclair-Desgagné contested the election results and requested a byelection following a complaint from a Bloc supporter who alleged that an attempt to vote by mail using a special ballot was not counted.
While a Superior Court judge initially dismissed Sinclair-Desgagné’s plea for a new election, the Supreme Court overturned this decision in a split ruling announced in February. Justice Mahmud Jamal, writing for the majority, highlighted that an Elections Canada staff member was aware for weeks that some voters had received envelopes with incorrect postal codes but no action was taken to rectify the situation.
In a subsequent byelection held in April, Auguste secured victory in the Terrebonne riding for the second time.
